Eastern District of Texas is Most Popular Place to File Patent Suit for 2012
As any patent litigator knows by now, the Eastern District of Texas, based in Tyler, is a quite popular district for plaintiffs to file patent lawsuits. Just in 2012, the Eastern District saw 1,266 cases filed, which was up from 418 in 2011. By comparison, the second place “winner” was the District of Delaware—which had 995 cases filed in 2012 versus 484 in 2011. To put this in perspective on a national scale, the Eastern District is where roughly 22.67% of the country’s 5,584 patent cases were filed in 2012. However, even though the number of cases increased in the Eastern District, the number of defendants who got sued actually fell by 16.47% in 2012. This is due to certain Patent-reform legislation that became effective in 2011, which cut the number of defendants that a plaintiff could join in one suit. The effect was that plaintiffs had to file more separate patent lawsuits against different defendants, which is likely the largest reason for the drastic increase in cases filed.
