Trademark Trial and Appeal Board Update by Remy Davis and Darin Klemchuk
The Trademark Trial and Appeal Board recently dismissed an opposition by giant Virgin Enterprises to pro se Applicant Steven E. Moore’s application to register the mark VIRGIN FARMS & Design for “agricultural grains for planting; agricultural seeds; bulbs for agricultural purposes; plantable seed paper comprised primarily of seeds for agricultural purposes; seeds for agricultural purposes; spores and spawn; unprocessed seeds for agricultural use.” Virgin Enterprises opposed the application based on a likelihood of confusion and dilution. In a non-precedential decision, the Board found that there was no similarity between the relevant goods and services, and that the Opposer did not present sufficient proof of fame to support a claim of dilution.
